California Code of Civil Procedure:

Governor Schwarzenegger signed California’s Electronic Discovery Act in early July 2009 after previously vetoing the bill in late September 2008. The amendments are largely analogous to the 2006 Federal Amendments, except the rules shift the burden to the responding party with regard to the accessibility of data. The rules basically assume all electronically stored information is accessible and allow the responding party to seek a protective order.
